On June 19, 1964, the plaintiff Thomas C. Townsend, while attending a horse show at the state fair park in West Allis, Wisconsin, was injured when a portable ticket booth near the Colosseum was blown over by the wind and struck him. He commenced this action against the defendants to recover damages for his personal injuries. The defendant state of Wisconsin (state) owns the state fair park and operates it through the defendant Wisconsin Exposition Department (department), a state agency created by sec. 27.30, Stats. The defendant Wisconsin Desert Horse Association, Inc. (Desert) had entered into a lease with the department in order to conduct the horse show in the Colosseum at the state fair park. This lease required the lessee to carry public liability insurance and to assume all responsibility for accidents or injuries to participants, spectators, or employees, during the horse show. The defendant American Horse Shows Association, Inc., the parent organization of Desert, and Desert were named insureds and the department was named an additional insured in the policy issued by General Insurance Company of America (General).
